Abstract

This presentation explores how Florida’s legal system can be used as a practical tool to help families whose loved ones are suffering from severe substance use disorders, mental illness, and repeated failed attempts at recovery. Drawing from real-world experience handling Baker Act, Marchman Act, and guardianship cases throughout Florida, the session will provide attendees with a clearer understanding of how legal intervention can sometimes create the structure, time, and accountability necessary for treatment and stabilization to occur. Families often come to clinicians and treatment providers after years of relapse, psychiatric crises, overdoses, hospitalizations, arrests, homelessness, or treatment refusal. Many providers understand the clinical challenges involved but may have limited familiarity with the legal options available when a person’s condition deteriorates to the point where they are unable or unwilling to make safe decisions for themselves. This presentation is designed to bridge that gap. Attendees will gain practical insight into the Baker Act, Marchman Act, emergency temporary guardianship, and related legal mechanisms that may be available in high-risk situations. The presentation will focus not only on the legal standards themselves, but also on the realities families face when trying to navigate the behavioral health system during a crisis. Topics will include recognizing when traditional approaches may no longer be sufficient, understanding the limitations and misconceptions surrounding involuntary intervention laws, and identifying opportunities for collaboration between attorneys, clinicians, treatment providers, and families. The session will also address common concerns surrounding stigma, autonomy, ethics, and treatment resistance.
